These Regulations, which are made under section 2(2) of the European Communities Act 1972, amend the provisions of the Pesticides (Maximum Residue Levels in Crops, Food and Feeding Stuffs) Regulations (Northern Ireland) 2006 (S.R. 2006 No. 220) (“the principal Regulations”).
The Regulations implement Commission Directives 2007/27/EC (O.J. No. L128, 16.5.2007, p. 31), 2007/28/EC (O.J. No. L135, 26.5.2007, p. 6), 2007/39/EC (O.J. No. L165, 27.6.2007 p. 25), 2007/56/EC (O.J. No. L243, 18.9.2007 p. 50) and 2007/73/EC (O.J. No. L329, 14.12.2007, p. 40) (in relation to Deltamethrin only. Directive 2007/73 contains a correction to the residue levels for raspberries).
The definition of “the Residues Directives” is updated (regulation 2(2)).
Regulation 2(3):
(a) amends Schedule 1 to the principal Regulations for the entries Deltamethrin and Maleic hydrazide; and
(b) inserts in Schedule 1 the new entries 1-Methylcyclopropene, Etoxazole, Indoxacarb, MCPA and MCPB, Mesosulfuron-methyl, Tolylfluanid and Triticonazole.
Regulation 2(4) omits the column for the pesticide Ioxynil from Part I of Schedule 2.
In Part II to Schedule 2 to the principal Regulations, regulation 2(5):
(c) inserts new maximum residue levels for the pesticides 1-Methylcyclopropene, Etoxazole, Indoxacarb, Ioxynil, MCPA and MCPB, Mesosulfuron-methyl, Tolylfluanid and Triticonazole; and
(d) substitutes maximum residue levels for the pesticides Azoxystrobin, Chlorfenapyr, Chlorothalonil, Deltamethrin, Diazinon, Folpet, Hexachlorobenzene (HCB), Iprodione, Lambda-cyhalothrin, Maleic hydrazide, Methalaxyl, Oxamyl, Quinoxyfen and Trifloxystrobin;
(e) adds three further footnotes.
Regulation 2(6) amends Column 2 (products included in the groups) of Schedule 3 to the principal Regulations.
