The Department of Agriculture and Rural Development[1], being a Department designated[2] for the purposes of section 2(2) of the European Communities Act (1972)[3] in relation to the Common Agricultural Policy of the European Community, in exercise of the powers conferred on it by the said section 2(2), hereby makes the following Regulations: Citation, commencement and interpretation 1. —(1) These Regulations may be cited as The Potatoes Originating in Egypt (Amendment No.2) Regulations (Northern Ireland) 2006 and shall come into operation on 1st January 2007. (2) In these Regulations, "the principle Regulations" refers to the Potatoes Originating in Egypt Regulations (Northern Ireland) 2004[4]. (3) The Interpretation Act (Northern Ireland) 1954[5] shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly. Amendment of the Potatoes Originating in Egypt Regulations (Northern Ireland) 2004 2. —(1) The principal Regulations are amended in accordance with paragraph 2. (2) In regulation 2 (interpretation) in paragraph (2), the definition of "the Decision" after the words "Commission Decision 2004/4/EC" insert "as amended by Commission Decision 2006/749/EC"[6]. Revocation 3. The Potatoes Originating in Egypt (Amendment) Regulations (Northern Ireland) 2006[7] are revoked. (This note is not part of the Regulations) These Regulations amend the Potatoes Originating in Egypt Regulations (Northern Ireland) 2004 (S.R. 2004/183) ("the principal Regulations") and revoke The Potatoes Originating in Egypt (Amendment) Regulations (Northern Ireland) 2006, authorising Member States temporarily to take emergency measures against the dissemination of Pseudomonas solanacearum (Smith) Smith (now referred to as Ralstonia solanacearum (Smith) Yabuuchi et al.) as regards Egypt. The Regulations amend regulation 2(2) of the principal Regulations. The Regulations insert, into the definition of the Decision, Commission Decision 2006/749/EC which amends and corrects the Decision (regulation 2). Decision 2006/749/EC renews the framework within which potatoes may be imported from Egypt into the territory of the European Community during the 2006/2007 season. No Regulatory Impact Assessment has been carried out in respect of the extension of these controls to the 2006/2007 season.
