The Department of the Environment makes the following Order in exercise of the powers conferred upon it by section 3(2) of the Local Government (Best Value) Act (Northern Ireland) 2002[1]. In accordance with section 3(6) of that Act, the Department has consulted persons appearing to it to represent councils and such other persons as appeared to the Department to be representative of interests affected by the proposals. Citation, commencement and interpretation 1. —(1) This Order may be cited as the Local Government Companies (Best Value) Order (Northern Ireland) 2006 and shall come into operation on 22nd January 2007. Power of district councils to establish or participate in companies
Section 18 of the Local Government Act (Northern Ireland) 1966[3] (district council powers respecting arts and entertainment). Article 67 of the Health and Personal Social Services (Northern Ireland) Order 1972[4] (co-operation between Health and Social Services Boards, district councils, etc). Article 4 of the Consumer Protection and Advice (Northern Ireland) Order 1977[5] (consumer advice). Part III of the Access to the Countryside (Northern Ireland) Order 1983[6] (access to open country). Article 10 of the Recreation and Youth Service (Northern Ireland) Order 1986[7] (provision by district councils of facilities for recreational, social, physical and cultural activities). Article 30-32 of the Tourism (Northern Ireland) Order 1992[8] (functions of district councils in relation to tourism). Article 17 of the Airports (Northern Ireland) Order 1994[9] (power of district councils to provide and maintain airports). Litter (Northern Ireland) Order 1994[10]. Waste and Contaminated Land (Northern Ireland) Order 1997[11]. Article 12 of the Museums and Galleries (Northern Ireland) Order 1998[12] (provision and maintenance of museums and galleries by district councils). Article 8 of the Local Government (Miscellaneous Provisions) (Northern Ireland) Order 2002[13] (powers of district councils in relation to economic development). Article 9 of the Local Government (Miscellaneous Provisions) (Northern Ireland) Order 2002 (powers of district councils in relation to community safety). (This note is not part of the Order) Section 1(1) of the Local Government (Best Value) Act (Northern Ireland) 2002 requires a district council to make arrangements for continuous improvement in the way in which its functions are exercised, having regard to a combination of economy, efficiency and effectiveness. This Order provides that, in exercising a function specified in the Schedule, a council may establish or participate in companies in order to carry out its duty under section 1(1) of that Act.
