The Department of Agriculture and Rural Development[1] being a Department designated[2] for the purposes of section 2(2) of the European Communities Act 1972[3] in exercise of the powers conferred on it by the said section 2(2) and of every other power enabling it in that behalf, hereby makes the following Regulations: Citation and commencement 1. These Regulations may be cited as the Agricultural Wages (Abolition of Permits to Infirm and Incapacitated Persons) Regulations (Northern Ireland) 2006 and shall come into operation on 1st December 2006. Interpretation 2. The Interpretation Act (Northern Ireland) 1954[4] shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly. Repeals 3. The enactments specified in the Schedule are repealed to the extent specified in the third column of the Schedule. (This note is not part of the Regulations) These Regulations implement provisions of Council Directive 2000/78/EC of 27th November 2000 establishing a general framework for equal treatment in employment and occupation (O.J. No. L 303, 2.12.2000, p. 16) in so far as it relates to disability discrimination in the payment of agricultural wages. They are also a consequence of the revocation of regulation 6 of the Disability Discrimination (Employment) Regulations (Northern Ireland) 1996 (SR 1996 No 419) by regulation 3 of the Disability Discrimination (Employment Field) (Leasehold Premises) Regulations (Northern Ireland) 2004 (SR 2004 No 374). These Regulations repeal article 6 of the Agricultural Wages (Regulation) (Northern Ireland) Order 1977 and paragraph 25 of Schedule 2 to the National Minimum Wage Act 1998 (c. 39). Article 6 provides for the grant of a permit exempting an agricultural employer from the requirement to pay an infirm or incapacitated worker the full statutory minimum wage set by the Agricultural Wages Orders.
