The Department for Regional Development[1] makes the following Regulations in exercise of the powers conferred by Articles 31(1) and (2) and 59(2) of the Street Works (Northern Ireland) Order 1995[2] and now vested in it[3]: Citation and commencement 1. These Regulations may be cited as The Street Works (Reinstatement) (Amendment) Regulations (Northern Ireland) 2006 and shall come into operation on 27th November 2006. Amendment 2. —(1) The Street Works (Reinstatement) Regulations (Northern Ireland) 1998[4] shall be amended as provided by paragraphs (2) to (6). (2) In regulation 1(2), for the definition of "the Code" substitute the following —

(b) for the words in column 3 of item 10, substitute "Paragraph S12.4".
(4) In the Table to regulation 3(3) for the words in column 3 of item 2, substitute "Paragraphs S2.2.1, S2.3.1, S2.4.1, S2.4.3, S2.6.2".
(This note is not part of the Order) These Regulations amend the Street Works (Reinstatement) Regulations (Northern Ireland) 1998 ("the 1998 Regulations"). The 1998 Regulations prescribe performance standards and requirements for the specification of materials to be used and the standards of workmanship to be observed by undertakers in reinstating streets by reference to a Code of Practice issued in 1998. The Department has approved the issue of a revised Code of Practice ("the new Code") and these Regulations change those references in the 1998 Regulations to paragraphs that have been renumbered in the new Code. The new Code entitled "Specification for the Reinstatement of Openings in Roads (2nd Edition)" is published by The Stationery Office Ltd. and may be obtained from the Stationery Office Bookshop, 16 Arthur Street, Belfast, BT1 4GD. The new Code has been notified to the European Commission pursuant to Directive 98/34/EC of 22nd June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and of rules on Information Society Services (O.J. No. L204, 21.07.98, p. 37-48) as amended by Directive 98/48/EC of 20th July 1998 (O.J. No. L217, 05.08.98, p. 18-26). Copies of the Directives can be obtained form the Stationery Office Bookshop.
