The Department for Employment and Learning, being designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to measures relating to the organisation of working time, makes the following Regulations in exercise of the powers conferred by that section: Citation and commencement 1. These Regulations may be cited as the Working Time (Amendment No.2) Regulations (Northern Ireland) 2006 and shall come into operation on 1st October 2006. Interpretation 2. The Interpretation Act (Northern Ireland) 1954[3] shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly. Offshore work 3. In regulation 2 (Interpretation) of the Working Time Regulations (Northern Ireland) 1998[4], in the definition of "offshore work", after the words "a vessel" insert the following phrase —
(This note is not part of the Regulations) These Regulations amend the Working Time Regulations (Northern Ireland) 1998 which implement Council Directive 2003/88/EC concerning aspects of the organisation of working time (O.J. No. L299, 18.11.2003, p.9). They confirm for the avoidance of doubt that the definition of offshore work includes work performed in the Northern Irish sector of the Continental Shelf as well as that performed within the territorial waters of the United Kingdom adjacent to Northern Ireland.
