The Department of the Environment, in exercise of the powers conferred by Article 123(2) of the Planning (Northern Ireland) Order 1991[1] makes the following Rules:
Citation and Commencement
1. These Rules may be cited as the Planning (Inquiry Procedure) (Amendment) Rules (Northern Ireland) 2006 and shall come into operation on 19th June 2006.
Amendment of the Planning (Inquiry Procedure) Rules (Northern Ireland) 2006
2. —(1) The Planning (Inquiry Procedure) Rules (Northern Ireland) 2006[2] shall be amended in accordance with paragraph (2).
(2) In Rule 2(1) delete the definition of "electronic communication" in its entirety and insert—

"electronic communication" has the meaning assigned to it by section 4 of the Electronic Communications Act (Northern Ireland) 2001[3];".

These Rules amend the Planning (Inquiry Procedure) Rules (Northern Ireland) 2006 which provide procedures to be followed in connection with inquiries required to be held under Article 123B of the Planning (Northern Ireland) Order 1991.
The Rules amend the definition of "electronic communication" to accord with the current definition provided by section 4 of the Electronic Communications Act (Northern Ireland) 2001 which was amended by the Communications Act 2003 (c.21).
