The Department for Employment and Learning, designated for the purposes of section 2(2) of the European Communities Act 1972[1] in relation to measures relating to the organisation of working time [2], makes the following Regulations in exercise of the powers conferred by section 2(2). Citation and commencement 1. These Regulations may be cited as the Working Time (Amendment) Regulations (Northern Ireland) 2006 and shall come into operation on 6th April 2006. Interpretation 2. The Interpretation Act (Northern Ireland) 1954 [3] shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly. Amendment to Regulations 3. Paragraph (2) of regulation 20 (unmeasured working time) of the Working Time Regulations (Northern Ireland) 1998 [4] shall be revoked. Sealed with the Official Seal of the Department for Employment and Learning on 15th March 2006. L.S.
(This note is not part of the Regulations) These Regulations, which are made under section 2(2) of the European Communities Act 1972 (c.68), amend the Working Time Regulations (Northern Ireland) 1998. The Working Time Regulations (Northern Ireland) 1998 implement Council Directive 2003/88/EC (O.J. No. L299 18.11.2003, p.9) (which consolidates Directive 93/104/EC (O.J. No. L307, 13.12.93, p18) as amended by Council Directive 2000/34/EC (O.J. No. L195, 01.08.2000, p.41) as from 2nd August 2004). The Working Time Regulations (Northern Ireland) 1998 impose (amongst other things) limits on the maximum weekly working time of workers and on the length of night work. Regulation 20(2) of those Regulations, which is revoked by regulation 3, provided an exemption from those limits in cases where a worker's working time was partly unmeasured or determined by the worker himself. Notes: [1] 1972 c. 68back [2] See the European Communities (Designation) Order 1997 (S.I. 1997/1174)back [4] S.R. 1998 No. 386; regulation 20(2) was inserted by regulation 5 of S.R. 2000 No.7; there are other amending statutory rules which are not relevant to these Regulations.back
