The Department of the Environment, in exercise of the powers conferred on it by Article 2(3) of the Waste and Contaminated Land (Northern Ireland) Order 1997[1] and of all other powers enabling it in that behalf, hereby makes the following regulations: Citation, commencement and interpretation 1. - (1) These Regulations may be cited as the Controlled Waste (Amendment) Regulations (Northern Ireland) 2003 and shall come into operation on 4th October 2003. (2) In these Regulations, "the principal Regulations" means the Controlled Waste Regulations (Northern Ireland) 2002[2]. Amendment of the principal Regulations 2. - (1) Regulations 3, 4, 6 and 8 of the principal Regulations as originally enacted shall be renumbered as Regulations 3(1), 4(1), 6(1) and 8(1). (2) For paragraphs (3) and (4) of regulation 8 (waste not to be treated as industrial or commercial waste) of the Controlled Waste Regulations (Northern Ireland) 2002 there shall be substituted -
(4) In this regulation "animal by-products" has the same meaning as in Article 2 of the Animal By-Products Order (Northern Ireland) 2002;".
(This note is not part of the Regulations.) These Regulations substitute regulation 8(3) and (4) of the Controlled Waste Regulations (Northern Ireland) 2002 and thereby refer to the Animal By-Products Order (Northern Ireland) 2002 rather than the Animal By-Products Regulations (Northern Ireland) 1993 (Regulation 2(2)).
