HARBOURS

Londonderry Port and Harbour (Variation of Pilotage Limits) Order (Northern Ireland) 2002

  Made 18th December 2002 
  To be laid before Parliament under paragraph 7(3) of the Schedule to the Northern Ireland Act 2000
  Coming into operation 17th February 2003 

Whereas the Department for Regional Development[1] has received an application from Londonderry Port and Harbour Commissioners in accordance with section 7(5) of the Pilotage Act 1987[2].

     And whereas the Department, in exercise of the powers conferred by section 1 of, and Schedule 1 to, the Harbours Act (Northern Ireland) 1970[3] and now vested in it[4] and of all other powers enabling it in that behalf, after consultation with the Londonderry Port and Harbour Commissioners and such other harbour authority or local authority which the Department considered likely to be affected by the Order in accordance with section 1(6) of that Act, hereby makes the following Order:

Citation and commencement
     1. This Order may be cited as the Londonderry Port and Harbour (Variation of Pilotage Limits) Order (Northern Ireland) 2002 and shall come into operation on 17th February 2003.

Extension of limits of jurisdiction for purposes of pilotage
    
2.  - (1) The limits within which Londonderry Port and Harbour Commissioners shall have jurisdiction for the purposes of pilotage under Part I of the Pilotage Act 1987 shall include (in addition to the existing harbour) the area shown on the map bounded by-

    (a) a straight line drawn from reference point Latitude 55° 11.60 North, Longitude 006° 57.90 West (Magilligan Point) to reference point Latitude 55° 13.60 North, Longitude 006° 51.00 West (marked (b) on the map);

    (b) a straight line drawn from reference point Latitude 55° 13.60 North, Longitude 006° 51.00 West to reference point Latitude 55° 15.50 North, Longitude 006° 51.00 West (marked (c) on the map);

    (c) a straight line drawn from reference point Latitude 55° 15.50 North, Longitude 006° 51.00 West to reference point Latitude 55° 15.50 North, Longitude 006° 55.30 West (marked (d) on the map);

    (d) a straight line drawn from reference point Latitude 55° 15.50 North, Longitude 006° 55.30 West to reference point Latitude 55° 14.20 North, Longitude 006° 55.30 West (marked (e) on the map).

    (2) In this Article "harbour" means the harbour at Londonderry as described in section 57 of the Londonderry Port and Harbour Act 1854[5]. "The map" means the map marked "Londonderry Port and Harbour (Variation of Pilotage Limits) Order (Northern Ireland) 2002" which has been signed and sealed with reference to this Order and deposited at the office of the Department for Regional Development, Clarence Court, 10-18 Adelaide Street, Belfast BT2 8GB.

EXPLANATORY NOTE

(This note is not part of the Order.)


By virtue of section 7(5) of the Pilotage Act 1987 a direction given by a competent harbour authority for the purpose of making pilotage compulsory for ships navigating in a specified area shall not apply to any area which is outside the authority's harbour unless the limits of jurisdiction of the authority for pilotage purposes has been extended to cover that area.

This Order accordingly extends the limits of jurisdiction of Londonderry Port and Harbour Commissioners for pilotage purposes under Part I of the Pilotage Act 1987 so as to include an area outside their harbour in respect of which the Commissioners consider that pilotage should be compulsory.

The applicants for this Order are the Londonderry Port and Harbour Commissioners.

The extended limits of jurisdiction for pilotage purposes are identified by means of a map marked "Londonderry Port and Harbour (Variation of Pilotage Limits) Order (Northern Ireland) 2002" which has been signed and sealed with reference to this Order and deposited at the office of the Department for Regional Development, Clarence Court, 10-18 Adelaide Street, Belfast BT2 8GB. Copies of the map have been deposited at Londonderry Port and Harbour Commissioners offices, Port Road, Lisahally, Londonderry, BT47 1FL, where they are available for inspection at any reasonable hour.
