AGRICULTURE

Beef Special Premium (Amendment) Regulations (Northern Ireland) 2002

  Made 5th November 2002 
  Coming into operation 1st January 2003 

The Department of Agriculture and Rural Development, being a Department designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the common agricultural policy of the European Community, in exercise of the powers conferred on it by the said section 2(2) and of every other power enabling it in that behalf, hereby makes the following Regulations:

Citation and commencement
     1. These Regulations may be cited as the Beef Special Premium (Amendment) Regulations (Northern Ireland) 2002 and shall come into operation on 1st January 2003.

Interpretation
    
2. The Interpretation Act (Northern Ireland) 1954[3] shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly.

Amendment of the Beef Special Premium Regulations (Northern Ireland) 2001
     3. The Beef Special Premium Regulations (Northern Ireland) 2001[4] shall be amended as provided in regulations 4 and 5.

Interpretation
     4. In regulation 2(2) for the definition of "Commission Regulation 2342/1999" there shall be substituted the following definition -

Specific requirements relating to applications for beef special premium
     5. For sub-paragraph (b) of regulation 5(4) there shall be substituted the following paragraph -

EXPLANATORY NOTE

(This note is not part of the Regulations.)


These Regulations, which come into operation on 1st January 2003, amend the Beef Special Premium Regulations 2001 which lay down implementing measures for the beef special premium scheme provided for in Article 4 of Council Regulation (EC) No. 1254/1999 on the common organisation of the market in beef and veal (O.J. No. L160, 26.6.1999, p. 21).

Regulation 4 of these Regulations updates references to Commission Regulation (EC) No. 2342/1999 in the 2001 Regulations to take account of amendments effected since the date of making of the 2001 Regulations.

Regulation 5 of these Regulations provides for an increase in the number of applications an applicant is entitled to make from ten to eighteen applications for second premium during any one calendar year.
