The Minister of the Environment, in exercise of the powers conferred on him by Article 1(2) of the Waste and Contaminated Land (Northern Ireland) Order 1997[1], and paragraph 11(2) of Schedule 12 to the Northern Ireland Act 1998[2] and of every other power enabling him in that behalf, hereby makes the following Order: Citation 1. This Order may be cited as the Waste and Contaminated Land (1997 Order) (Commencement No. 6) Order (Northern Ireland) 2002. Appointed Day 2. Article 5 of the Waste and Contaminated Land (Northern Ireland) Order 1997, in so far as it is not already in operation shall come into operation on 3rd June 2002. L.S.
(This note is not part of the Order.) This Order brings into operation on 3rd June 2002 Article 5 of the Waste and Contaminated Land (Northern Ireland) Order 1997 which imposes a duty of care on anyone who imports, produces, carries, keeps, treats or disposes of controlled waste or, as a broker, has control of such waste and which enables the Department to make regulations in relation to the duty of care and issue a code of practice for the purpose of providing practical guidance on how to discharge the duty. (This note is not part of the Order.) The following provisions of the Waste and Contaminated Land (Northern Ireland) Order 1997 have been brought into operation by earlier commencement orders as from the dates shown.
