The Office of the First Minister and deputy First Minister, in exercise of the powers conferred on it by sections 30(5) and 31 of the Regulation of Investigatory Powers Act 2000[1] and of every other power enabling it in that behalf, hereby makes the following Order: Citation and commencement 1. This Order may be cited as the Regulation of Investigatory Powers Act 2000 (Amendment) Order (Northern Ireland) 2002 and shall come into operation on the day after it is affirmed by resolution of the Assembly. Amendment of the Regulation of Investigatory Powers Act 2000 2. The Regulation of Investigatory Powers Act 2000 shall be amended in accordance with Articles 3 and 4. 3. In Part I of Schedule 1 after paragraph 23 there shall be added the following paragraphs -
23A. The Department of Agriculture and Rural Development. 23B. The Department of Enterprise, Trade and Investment. 23C. The Department of the Environment. 23D. Any district council (within the meaning of section 44 of the Interpretation Act (Northern Ireland) 1954[2]).".

In Part II of Schedule 1 after paragraph 28 there shall be added the following paragraphs -
29. The Department of Health, Social Services and Public Safety. 30. The Department for Regional Development. 31. The Department for Social Development. 32. The Department of Culture, Arts and Leisure. 33. The Foyle, Carlingford and Irish Lights Commission. 34. The Fisheries Conservancy Board for Northern Ireland. 35. A Health and Social Services trust established under Article 10 of the Health and Personal Social Services (Northern Ireland) Order 1991[3]. 36. A Health and Social Services Board established under Article 16 of the Health and Personal Social Services (Northern Ireland) Order 1972[4]. 37. The Health and Safety Executive for Northern Ireland. 38. The Northern Ireland Central Services Agency for the Health and Social Services. 39. The Fire Authority for Northern Ireland. 40. The Northern Ireland Housing Executive.".
(This note is not part of the Order.) This Order amends the Regulation of Investigatory Powers Act 2000 ("the 2000 Act") by adding various Northern Ireland public authorities to the lists of public authorities in Schedule 1 to that Act. Officers of such authorities prescribed by an order under section 30 of the 2000 Act will be entitled to grant authorisations for the purposes of section 28 or 29 of that Act.
