The Department for Social Development, in exercise of the powers conferred by sections 30E(1) and 171(1) to (4) of the Social Security Contributions and Benefits (Northern Ireland) Act 1992[1], and now vested in it[2], and of all other powers enabling it in that behalf, hereby makes the following Regulations: Citation and commencement 1. These Regulations may be cited as the Social Security Benefits Up-rating and Miscellaneous Increases Regulations (Northern Ireland) 2000 and shall come into operation on 10th April 2000. Amendment of the Social Security (Incapacity Benefit) Regulations 2. In regulation 7 of the Social Security (Incapacity Benefit) Regulations (Northern Ireland) 1994[3] (limit of earnings from councillor's allowance) for "£49·50" there shall be substituted "£58·50". Revocation 3. Regulation 5 of the Social Security Benefits Up-rating Regulations (Northern Ireland) 1999[4] is hereby revoked. (This note is not part of the Regulations.) These Regulations increase from £49·50 to £58·50 the limit of earnings from a councillor's allowance in relation to incapacity benefit. The increase is partly consequential on an order under section 132 of the Social Security Administration (Northern Ireland) Act 1992, and also aligns the councillor's allowance limit with the therapeutic earnings limit in incapacity benefits. The Regulations also contain a consequential revocation. These Regulations make in relation to Northern Ireland only provision corresponding to provision contained in Regulations made by the Secretary of State for Social Security in relation to Great Britain and accordingly, by virtue of section 149(3) of, and paragraph 10 of Schedule 5 to, the Social Security Administration (Northern Ireland) Act 1992, are not subject to the requirement of section 149(2) of that Act for prior reference to the Social Security Advisory Committee.
