The Department of Agriculture, being satisfied that the modifications of Schedule 2 to the Disease of Animals (Northern Ireland) Order 1981[1] set out in Article 2 are necessary or expedient for the purposes of that Order, in exercise of the powers conferred on it by Article 16(2) of that Order and of every other power enabling it in that behalf, hereby makes the following Order: Citation and commencement 1. This Order may be cited as the Disease of Animals (Modification) Order (Northern Ireland) 1999 and shall come into operation on 10th June 1999. Modification of the Diseases of Animals (Northern Ireland) Order 1981 2. For paragraph 4 of Part I of Schedule 2 to the Diseases of Animals (Northern Ireland) Order 1981 there shall be substituted the following paragraph -
4. - (1) Subject and according to the provisions of this Order, the Department may by order provide for the slaughter of -
(b) any animal of a susceptible species which is or has been in contact with any animal referred to in paragraph (a), or which appears to the Department to have been in any way exposed to the infection of bovine tuberculosis.
(2) An order under sub-paragraph (1) may provide for the slaughter of any animal under that sub-paragraph to be made subject to such conditions as may be prescribed by or under the order.
(b) "animal of a susceptible species" means any animal or bird -
(ii) of any other species which presents a serious risk of transmitting bovine tuberculosis to animals or poultry of the species referred to in sub-paragraph (i) or to humans.".
(This note is not part of the Order.) This Order modifies Part I of Schedule 2 to the Diseases of Animals (Northern Ireland) Order 1981 by extending the Department's power to slaughter in respect of bovine tuberculosis to -
(b) animals (including cattle) and poultry which have been exposed to the possibility of infection with that disease, whether by contact with affected or suspected animals or otherwise.
