The Department of Health and Social Services, in exercise of the powers conferred on it by section 70(3) of the Disability Discrimination Act 1995[1] and of all other powers enabling it in that behalf, hereby makes the following Order: Citation and interpretation 1. - (1) This Order may be cited as the Disability Discrimination Act 1995 (Commencement No. 6) Order (Northern Ireland) 1999. (2) The Interpretation Act (Northern Ireland) 1954[2] shall apply to this Order as it applies to a Measure of the Northern Ireland Assembly. Appointed days 2. - (1) The day appointed for the coming into operation of the provisions of the Disability Discrimination Act 1995 specified in Article 3 is 26th April 1999. (2) The day appointed for the coming into operation of the provisions of the Disability Discrimination Act 1995 specified in Article 4 is 1st October 1999. Provisions commenced on 26th April 1999 3. The provisions referred to in Article 2(1) are-
(b) section 21(5) (regulations affecting the duty of providers of services to make adjustments).
Provisions commenced on 1st October 1999
(b) section 15(1)(a) and (2) to (10) (duty of trade organisations to make adjustments); (c) section 19(1)(b) (discrimination in relation to goods, facilities and services); (d) section 20(2) (meaning of "discrimination"); (e) section 20(5) (costs disregard); (f) section 20(9) (meaning of "treatment"); (g) section 21(1), (2)(d), (4), (6) and (10) (duty of providers of services to make adjustments).
(This note is not part of the Order.) This Order provides for the coming into operation on 26th April 1999 of provisions in the Disability Discrimination Act 1995 ("the Act") enabling the making of Regulations. It also provides for the coming into operation on 1st October 1999 of section 14(2), (4) and (5) and section 15 (save for section 15(1)(b)) of the Act which relate to the duty of trade organisations to make adjustments for disabled persons. It further provides for the coming into operation on 1st October 1999 of sections 19(1)(b), 20(2), (5) and (9), and 21(1), (2)(d), (4), (6) and (10) of the Act which relate to the duty of providers of services to make adjustments for disabled persons. A Regulatory Impact Assessment including the costs and benefits of the coming into operation of sections 19(1)(b), 20(2), (5) and (9), 21(1), (2)(d), (4), (6) and (10) of the Act can be obtained by post from Robert Gray, Social Policy Branch, Department of Health and Social Services, Room C.4.22, Castle Buildings, Stormont, Belfast BT4 3PP. A Regulatory Impact Assessment of the costs and benefits of the coming into operation of section 14(2), (4) and (5) and section 15(1)(a), (2) to (5) and (10) of the Act can be obtained by post from Mairead Mageean, Disablement Advisory Service, Training and Employment Agency, Adelaide House, 39-49 Adelaide Street, Belfast BT2 8FD. The following provisions of the Disability Discrimination Act 1995, as modified in its application to Northern Ireland by Schedule 8 thereof, have been brought into operation by Commencement Orders made before the date of this Order: -
