In the exercise of the powers conferred on me by Article 1(2) of the Family Homes and Domestic Violence (Northern Ireland) Order 1998[1] and of all other powers enabling me in that behalf, I hereby make the following Order: Citation and interpretation 1. - (1) This Order may be cited as the Family Homes and Domestic Violence (1998 Order) (Commencement No. 1) Order (Northern Ireland) 1999. (2) In this Order "the 1998 Order" means the Family Homes and Domestic Violence (Northern Ireland) Order 1998. Appointed day 2. - (1) The following provisions of the 1998 Order, that is to say -
(b) Article 39(4) and (6) and (11) (Appeals); (c) Article 40(2) (Orders and regulations); and (d) Paragraph 13 of Schedule 2 (Rules of court)
shall, to the extent that they authorise the making of orders and rules of court by the Lord Chancellor, come into operation on the day following the date on which this Order is made.
(b) Article 2 (Interpretation); (c) Article 30 (Transfer of certain tenancies); (d) Article 34(1), (2) and (10) (Jurisdiction of courts and procedure); (e) Article 40(1) (Orders and regulations); and (f) Paragraph 1 of Schedule 2 (Interpretation of Schedule 2)
shall, insofar as they relate to the making of orders and rules of court under the provisions referred to in paragraph (1), come into operation on the day following the date on which this Order is made. (This note is not part of the Order.) This Order brings into operation on 10th February 1999 the following provisions of the Family Homes and Domestic Violence (Northern Ireland) Order 1998 -
(b) Article 2 (Interpretation); (c) Article 30 (Transfer of certain tenancies); (d) Article 34 (Jurisdiction of courts and procedure); (e) Article 39(4) and (6) and (11) (Appeals); (f) Article 40(1) and (2) (Orders and regulations); and (g) Paragraph 1 (Interpretation) and paragraph 13 (Rules of court) of Schedule 2.
