PLANT HEALTH

The Plant Health (Amendment) Order (Northern Ireland) 1999

  Made 21st January 1999 
  Coming into operation 19th February 1999 

The Department of Agriculture, in exercise of the powers conferred on it by sections 2[1], and 3(1)[2], 3A[3], 3B(1)[4] and 4(1)[5] of the Plant Health Act (Northern Ireland) 1967[6] and of all powers enabling it in that behalf, hereby makes the following Order:

Citation and commencement
     1. This Order may be cited as the Plant Health (Amendment) Order (Northern Ireland) 1999 and shall come into operation on 19th February 1999.

Amendment of the Plant Health Order (Northern Ireland) 1993
    
2.  - (1) The Plant Health Order (Northern Ireland) 1993[7] shall be amended in accordance with paragraph (2).

    (2) After Article 25(b)(iii) there shall be added-

        " (iv) require the owner or occupier or the person in charge of the premises in which the examination takes place, to provide-

          (a) suitable areas for inspection, where appropriate;

          (b) adequate lighting; and

          (c) inspection tables.".

Amendment of the Plant Health (Wood and Bark) Order (Northern Ireland) 1993
     3.  - (1) The Plant Health (Wood and Bark) Order (Northern Ireland) 1993[8] shall be amended in accordance with paragraph (2).

    (2) After Article 23(b)(iv) there shall be added-

        " (v) require the owner or occupier or the person in charge of the premises in which the examination takes place, to provide-

          (a) suitable areas for inspection, where appropriate;

          (b) adequate lighting; and

          (c) inspection tables, where appropriate.".

EXPLANATORY NOTE

(This note is not part of the Order.)


This Order which comes into operation on 19th February 1999 further amends the Plant Health Order (Northern Ireland) 1993 and the Plant Health (Wood and Bark) Order (Northern Ireland) 1993. The Order implements as respects Northern Ireland Commission Directive 98/22/EC (O.J. No. L.126, 28.4.98, p. 26) which lays down the minimum conditions for carrying out plant health checks in the Community, at inspection posts other than those at the place of destination, of plants, plant products or other objects coming from third countries.

It provides that an inspector may require the occupier or other person in charge of premises where an examination of material imported from a third country is taking place to provide, where appropriate, suitable inspection areas, adequate lighting and inspection tables.
