The Department of Health and Social Services for Northern Ireland in exercise of the powers conferred by sections 7, 10 and 31 of the Misuse of Drugs Act 1971[1] as adapted by section 38 of that Act and now vested in it[2] and of every other power enabling it in that behalf and after consultation in accordance with section 31(3) of that Act with the Advisory Council on the Misuse of Drugs, hereby makes the following regulations: - Citation and commencement 1. These regulations may be cited as the Misuse of Drugs (Amendment) Regulations (Northern Ireland) 1998 and shall come into operation on 1st May 1998. Interpretation 2. The Interpretation Act (Northern Ireland) 1954[3] shall apply to these regulations as it applies to a Measure of the Northern Ireland Assembly. Amendment of the Misuse of Drugs (Northern Ireland) Regulations 1986 3. - (1) The Misuse of Drugs (Northern Ireland) Regulations 1986[4] shall be amended in accordance with the following provisions. (2) In paragraph 1(a) of Schedule 1, there shall be inserted -
(b) after the word "Mescaline", the word "Methcathinone".
(3) In paragraph 1 of Schedule 2, after the word "Trimeperidine", there shall be inserted the word "Zipeprol".
(b) after the word "Bromazepam", the word "Brotizolam"; and (c) after the word "Mefenorex"[6], the word "Mesocarb".
(This note is not part of the Regulations.) These Regulations amend the Misuse of Drugs (Northern Ireland) Regulations 1986 ("the 1986 Regulations") by adding Etryptamine and Methcathinone to Schedule 1; Zipeprol to Schedule 2; and Aminorex, Brotizolam and Mesocarb to Schedule 4 Part II. These drugs became subject to control under the Misuse of Drugs Act 1971 by virtue of the Misuse of Drugs Act 1971 (Modification) Order 1998 (S.I. 1998/ 750). These Regulations also transfer Flunitrazepam from Schedule 4 Part II to Schedule 3 to the 1986 Regulations. Notes: [1] 1971 c. 38back [2] By S.R. & O.
