HOUSING

The Housing Benefit (General) (Amendment No. 2) Regulations (Northern Ireland) 1998

  Made 19th March 1998 
  Coming into operation 1st June 1998 

The Department of Health and Social Services for Northern Ireland, in exercise of the powers conferred on it by sections 122(1)(d) and 129(4) of the Social Security Contributions and Benefits (Northern Ireland) Act 1992[1] and of all other powers enabling it in that behalf, and after agreement by the Social Security Advisory Committee that proposals in respect of these Regulations should not be referred to it[2], hereby makes the following Regulations:

Citation, commencement and interpretation
     1.  - (1) These Regulations may be cited as the Housing Benefit (General) (Amendment No. 2) Regulations (Northern Ireland) 1998 and shall come into operation on 1st June 1998.

    (2) The Interpretation Act (Northern Ireland) 1954[
3] shall apply to these Regulations as it applies to a Measure of the Northern Ireland Assembly.

Amendment of the Housing Benefit (General) Regulations
     2.  - (1) The Housing Benefit (General) Regulations (Northern Ireland) 1987[4] shall be amended in accordance with paragraphs (2) and (3).

    (2) In regulation 10A(3)(a)[5] (determinations) for "under paragraph 3 or 4" there shall be substituted "under paragraph 3, 4 or 4A".

    (3) In Schedule 1A[6] (determinations of rent payable) in paragraph 4A(2)[7] (single room rents) for head (b)(iv) there shall be substituted - 

        " (iv) shares the use of a kitchen and does not have the exclusive use of facilities for cooking food, and".

EXPLANATORY NOTE

(This note is not part of the Regulations.)


These Regulations further amend the Housing Benefit (General) Regulations (Northern Ireland) 1987.

Regulation 2(2) extends the provisions to include single room rent for which a determination is not required.

Regulation 2(3) amends the criteria under which a single room rent is to be determined.
