AGRICULTURE

Deseasonalisation Premium (Protection of Payments) (Amendment) Regulations (Northern Ireland) 1997

Made 2nd December 1997
Coming into operation 1st January 1998


    The Department of Agriculture, being a Department designated[1] for the purpose of section 2(2) of the European Communities Act 1972[2] in relation to the common agricultural policy of the European Community, in exercise of the powers conferred on it by the said section 2(2) and every other power enabling it in that behalf, hereby makes the following Regulations:—
    Citation and commencement
        1.    These Regulations may be cited as the Deseasonalisation Premium (Protection of Payments) (Amendment) Regulations (Northern Ireland) 1997 and shall come into operation on 1st January 1998.
    Interpretation
        2.—(1)  In these Regulations "the principal Regulations" means the Deseasonalisation Premium (Protection of Payments) Regulations (Northern Ireland) 1996[3].

        (2)  The Interpretation Act (Northern Ireland) 1954[4] shall apply to these Regulations as it applies to a Measure of the Northern Ireland Assembly.
    Amendment of the principal Regulations
        3.—(1)  The principal Regulations shall be amended in accordance with paragraphs (2) and (3).

        (2)  In regulation 2(2) for the definition of "animal" there shall be substituted the following—
      ""animal" means a castrated male animal of the bovine species which is slaughtered during the period 1st January 1998 to 10th June 1998 (both dates inclusive)" .


        (3)  The following paragraph shall be substituted for regulation 3(2) (application for premium payments)—
      "  (2)  An application under paragraph (1) shall be lodged with the Department during the period 1st July 1998 to 12th September 1998 (both dates inclusive)" .

EXPLANATORY NOTE

(This note is not part of the Regulations.)
    Article 4c of Council Regulation (EEC) No. 805/68 (O.J. No. L148, 28.6.68, p. 24 (O.J./SE 1968 (1) p. 187)) (inserted by Council Regulation (EEC) No. 2066/92 (O.J. No. L215, 30.7.92, p. 49)) as amended provides for the payment to beef and veal producers of a deseasonalisation premium. Detailed rules for the administration of the premium are laid down in Articles 1, 19 to 22, 42 to 45, and 54 to 61 of the Commission Regulation (EEC) No. 3886/92 (O.J. No. L391, 21.12.92, p. 20) as amended.
    The Deseasonalisation Premium (Protection of Payments) Regulations (Northern Ireland) 1996 (the principal Regulations) supplement the relevant provisions of the council and commission Regulations.
    These Regulations amend the principal Regulations to provide that a producer making an application for Deseasonalisation Premium in respect of the 1998 marketing year shall deliver his application between the dates of 1st July 1998 and 12th September 1998.
    A consequential change is made to the definition of "animal" in the principal Regulations.
