The Health and Social Services Trusts (Establishment Orders) (Amendment) Order (Northern Ireland) 1996

Made 31st October 1996
Coming into operation 4th November 1996


    The Department of Health and Social Services, in exercise of the powers conferred on it by Article 10(1) of, and paragraphs 1 and 3A of Schedule 3 to, the Health and Personal Social Services (Northern Ireland) Order 1991[1], and of all other powers enabling it in that behalf, hereby makes the following order:
    Citation, commencement and interpretation
        1.—(1)  This order may be cited as the Health and Social Services Trusts (Establishment Orders) (Amendment) Order (Northern Ireland) 1996 and shall come into operation on 4th November 1996.

        (2)  In this order—
      "relevant establishment orders" means—

      the Armagh and Dungannon Health and Social Services Trust (Establishment) Order (Northern Ireland) 1995[2],

      the Causeway Health and Social Services Trust (Establishment) Order (Northern Ireland) 1995[3],

      the Craigavon and Banbridge Community Health and Social Services Trust (Establishment) Order (Northern Ireland) 1993[4],

      the Down Lisburn Health and Social Services Trust (Establishment) Order (Northern Ireland) 1993[5],

      the Foyle Health and Social Services Trust (Establishment) Order (Northern Ireland) 1995[6],

      the Homefirst Community Health and Social Services Trust (Establishment) Order (Northern Ireland) 1996[7],

      the Newry and Mourne Health and Social Services Trust (Establishment) Order (Northern Ireland) 1993[8],

      the North and West Belfast Health and Social Services Trust (Establishment) Order (Northern Ireland) 1993[9],

      the North Down and Ards Community Health and Social Services Trust (Establishment) Order (Northern Ireland) 1993[10],

      the South and East Belfast Health and Social Services Trust (Establishment) Order (Northern Ireland) 1993[11] and

      the Sperrin Lakeland Health and Social Services Trust (Establishment) Order (Northern Ireland) 1996[12].

    Amendment of the relevant establishment orders
        2.—(1)  Each of the relevant establishment orders shall be amended in accordance with paragraphs (2) and (3).

        (2)  In Part I of the Schedule—

      (a)  in the first column (Statutory Provision) there shall be added at the end the words "Children (Northern Ireland) Order 1995[13]"; and

      (b)  in the second column (Relevant Function) there shall be added at the end, opposite the reference to the Children (Northern Ireland) Order 1995, the words "All relevant functions".

        (3)  In Part II of the Schedule—

      (a)  in the first column (Statutory Provision) there shall be added at the end the words "Children (Northern Ireland) Order 1995";

      (b)  in the second column (Relevant Function) there shall be added at the end, opposite the reference to the Children (Northern Ireland) Order 1995, the words "Articles 21, 23, 26, 27, 32, 54, 66 and Schedule 3"; and

      (c)  in the second column (Relevant Function), in the entry relating to the Children and Young Persons Act (Northern Ireland) 1968[14], references to Part VII and sections 94(2), 105(3), 152, 154 to 159 and 164 shall cease to have effect.

EXPLANATORY NOTE

(This note is not part of the Order.)

    This order makes amendments to those orders under Article 10(1) of the Health and Personal Social Services (Northern Ireland) Order 1991 establishing certain Health and Social Services trusts, in order to take account of the introduction of most of the provisions of the Children (Northern Ireland) Order 1995 ("the 1995 Order").
    The amendments specify the operational areas within which the relevant trusts may exercise the statutory functions conferred on a Health and Social Services Board under the 1995 Order and which are delegated to those trusts.
