AGRICULTURE

Pig Production Development (Levy) Order (Northern Ireland) 1996

Made 21st October 1996
Coming into operation 2nd December 1996


    The Department of Agriculture in exercise of the powers conferred on it by section 5(1), (2) and (3) of the Pig Production Development Act (Northern Ireland) 1964[1] and of every other power enabling it in that behalf, on the recommendation of the Northern Ireland Pig Production Development Committee[2], hereby makes the following Order:—
    Citation and commencement
        1.    This Order may be cited as the Pig Production Development (Levy) Order (Northern Ireland) 1996 and shall come into operation on 2nd December 1996.
    Rate of levy on pigs sold for slaughter or exported
        2.    There shall be payable to the Department on behalf of the Committee a levy of 21p by:—

      (a)  every holder of a licence under section 1 of the Slaughter-houses Act (Northern Ireland) 1953[3] in respect of each pig slaughtered in the slaughter-house to which the licence relates, not being a pig imported into Northern Ireland for immediate slaughter; and

      (b)  every person exporting pigs from Northern Ireland in respect of each pig so exported by him.
    Keeping of records
        3.—(1)  A person required to pay a levy in accordance with Article 2(a) in respect of a pig shall keep a record showing—

      (a)  the date on which that pig was slaughtered; and

      (b)  the total number of such pigs slaughtered on that day.

        (2)  A person required to pay a levy in accordance with Article 2(b) in respect of a pig shall keep a record showing—

      (a)  the date on which that pig was exported from Northern Ireland;

      (b)  the destination to which that pig was exported; and

      (c)  the total number of pigs so exported on that day.

        (3)  A record kept in accordance with paragraph (1) or (2) shall—

      (a)  be produced at all reasonable times for inspection by the Department; and

      (b)  be retained for a period of at least 2 years from the date of the last entry therein.

    Payment of levies
        4.—(1)  A person required to pay a levy in accordance with Article 2 shall make a return in writing to the Department within 7 days of the end of each month showing—

      (a)  the total number of pigs (other than pigs imported into Northern Ireland for immediate slaughter) slaughtered in a slaughter-house to which a licence under section 1 of the Slaughter-houses Act (Northern Ireland) 1953 relates; and

      (b)  the total number of pigs exported from Northern Ireland,
    in that month.

        (2)  A return made in accordance with paragraph (1) shall be accompanied by the appropriate amount of levy in respect of those pigs.
    Recovery of levy and payment of expenses
        5.—(1)  Any sum due in respect of levy under this Order shall be recoverable by the Department as a civil debt.

        (2)  Any reasonable expenses incurred by the Department in recovering the levy shall be paid out of the Development Fund.
    Revocations
        6.    The following Orders are hereby revoked—

      (a)  the Pig Production Development (Levy) Order (Northern Ireland) 1981[4];

      (b)  the Pig Production Development (Levy) (Amendment) Order (Northern Ireland) 1995[5].

EXPLANATORY NOTE

(This note is not part of the Order.)

    This Order, which comes into operation on 2nd December 1996, revokes and replaces the Pig Production Development (Levy) Order (Northern Ireland) 1981.
    The Order provides for the payment of a levy to the Department on pigs either slaughtered in Northern Ireland or exported from Northern Ireland. A levy of 21p per head is payable in respect of certain pigs slaughtered by slaughter-house licence-holders under the Slaughter-houses Act (Northern Ireland) 1953 and by exporters in respect of all pigs exported from Northern Ireland (Article 2).
    A person required to pay a levy must keep certain records and produce them for inspection and must make monthly returns to the Department (Articles 3 and 4).
    Article 5 provides for recovery of levy and payment of expenses.
    Article 6 contains revocations.
