STATUTORY RULES OF NORTHERN IRELAND

FOOD

Fresh Meat (Beef Controls) (Amendment) Regulations (Northern Ireland) 1996

Made 23rd October 1996
Coming into operation 24th October 1996


    Whereas it appears to the Department of Agriculture acting as the Department concerned that it is necessary or expedient—

      (a)  for the purpose of securing that food complies with food safety requirements or in the interests of public health; or

      (b)  for the purposes of protecting or promoting the interests of consumers,
    to make the following Regulations.
    Now therefore the said Department concerned, in exercise of the powers conferred on it by Articles 15(1)(f), 25(1) and (3), 26(3), 44(1) and 47(2) of the Food Safety (Northern Ireland) Order 1991[1] and of every other power enabling it in that behalf and after consultation in accordance with Article 47(3) of the said Order with such organisations as appear to it to be representative of interests likely to be substantially affected by these Regulations, hereby makes the following Regulations:—
    Citation and commencement
        1.    These Regulations may be cited as the Fresh Meat (Beef Controls) (Amendment) Regulations (Northern Ireland) 1996 and shall come into operation on 24th October 1996.
    Amendment of the Fresh Meat (Beef Controls) Regulations (Northern Ireland) 1996
        2.—(1)  The Fresh Meat (Beef Controls) Regulations (Northern Ireland) 1996[2] shall be amended as provided in paragraphs (2) to (4).

        (2)  In Article 2, after the definition of "the Department" there shall be inserted the following definition—

          ""mammalian meat and bone meal" shall have the meaning given to it in the Specified Bovine Material (No. 2) Order (Northern Ireland) 1996[3];" .

        (3)  In Part I of Schedule 1—

      (a)  for paragraph 7(1) there shall be substituted the following sub-paragraph—

              7.—(1)  The herd shall have been in existence for four years, except where, at the time of the application, every bovine animal in the herd came from a registered herd." ;


      (b)  in paragraphs 8 and 9(a), there shall be inserted before the word "meat" in both places where it occurs the word "mammalian"; and

      (c)  in paragraph 9(b), for the words "which only produced feed for ruminants" there shall be substituted the words "in which, over the four years prior to the application, mammalian meat and bone meal has not knowingly been stored or used";

        (4)  For paragraph 5 of Part II of Schedule 1 there shall be substituted the following paragraph—

            5.    "A bovine animal in the herd shall not be fed any feed or compound feed, which contains mammalian meat and bone meal." .

EXPLANATORY NOTE

(This note is not part of the Regulations.)

    These Regulations alter the conditions of eligibility and the conditions of continued membership of the Beef Assurance Scheme established under the Fresh Meat (Beef Controls) Regulations (Northern Ireland) 1996.
    The condition of eligibility that the herd must have been in existence for four years prior to registration is disapplied where the herd in question is composed entirely of animals which come from herds which are themselves already registered under the Beef Assurance Scheme.
    The condition of eligibility that a bovine animal in the herd shall not have been fed any feed (including home mixed feed) containing meat and bone meal is also changed so as to require that the animal shall not have been fed any feed containing mammalian meat and bone meal.
    The condition of eligibility that, over the four year period prior to application for membership of the Scheme, a bovine animal in the herd shall not be fed any compound feed except from a feed mill which solely produced feed for ruminants is replaced by a new requirement that any compound feed so fed must have come from a mill which has not during the four years prior to application stored or used mammalian meat and bone meal.
    The condition of continued membership that a bovine animal in the herd shall not be fed feed containing meat and bone meal or any compound feed except from a mill which solely produced feed for ruminants is replaced by the requirement that any feed or compound feed so fed must not contain mammalian meat and bone meal.
