WELFARE OF ANIMALS

Welfare of Animals (Scheduled Operations) (Amendment) Order (Northern Ireland) 1995

Made 14th April 1995
To be laid before Parliament under paragraph 3(3) of Schedule 1 to the Northern Ireland Act 1974
Coming into operation 12th June 1995


    The Department of Agriculture, in exercise of the powers conferred on it by section 14(3) of the Welfare of Animals Act (Northern Ireland) 1972[1] and of every other power enabling it in that behalf, hereby makes the following Order:
    Citation and commencement
        1.    This Order may be cited as the Welfare of Animals (Scheduled Operations) (Amendment) Order (Northern Ireland) 1995 and shall come into operation on 12th June 1995.
    Amendment of the welfare of Animals Act (Northern Ireland) 1972
        2.    In Schedule 1 to the Welfare of Animals Act (Northern Ireland) 1972 (Operations which ma>be performed without an anaesthetic)[2] for paragraph 7(ii) there shall be substituted—
        "(ii) by any other means—
          (a) in the case of a calf or goat, before the age of two months;
          (b) in the case of a pig, before the age of four weeks; and
          (c) in the case of a lamb, before the age of three months." .

EXPLANATORY NOTE

(This note is not part of the Order.)
    This Order amends Schedule 1 to the Welfare of Animals Act (Northern Ireland) 1972 by reducing from 2 months to 4 weeks the maximum age at which a pig may be castrated without the use of an anaesthetic by any means other than a constricting device. This implements paragraph 3 of Part III of Chapter II to the Annex to Council Directive 91/630/EEC laying down minimum standards for the protection of pigs (O.J. No. L340, 11.12.91, p. 33).
    The maximum age of 3 months in relation to such castration of a lamb and 2 months in relation to a goat or calf remain unchanged.
