SOCIAL SECURITY

The Social Security (Industrial Injuries) (Dependency) (Permitted Earnings Limits) Order (Northern Ireland) 1991

Made 8th March 1991
Coming into operation 8th April 1991


    The Department of Health and Social Services for Northern Ireland, in exercise of the powers conferred on it by section 64(1C) of the Social Security (Northern Ireland) Act 1975[1] and of all other powers enabling it in that behalf, hereby makes the following order:
    Citation and commencement
        1.    This order may be cited as the Social Security (Industrial Injuries) (Dependency) (Permitted Earnings Limits) Order (Northern Ireland) 1991 and shall come into operation on 8th April 1991.
    Increase of earnings limits in respect of dependent children
        2.    In section 64(1B) of the Social Security (Northern Ireland) Act 1975(a)
       (a) in paragraph (a) for the amount of £100 there shall be substituted the amount of £110; and
       (b) in paragraph (b) for the amounts of £13 and £100 there shall be substituted the amounts of £14 and £110 respectively.
    Revocation
        3.    The Social Security (Industrial Injuries) (Dependency) (Permitted Earnings Limits) (Northern Ireland) Order 1990[2] is hereby revoked.

EXPLANATORY NOTE

(This note is not part of the Order.)
    Where a disablement pension with unemployability supplement is increased in respect of a child and the beneficiary is one of two persons who are spouses residing together or an unmarried couple, section 64(1B) of the Social Security (Northern Ireland) Act 1975 provides that an increase shall not be payable in respect of the first child if the other person's earnings are £100 a week or more and an increase shall not be payable in respect of a further child for each complete £13 by which the earnings exceed £100. This order substitutes the amount of £110 for the amount of £100 and £14 for the amount of £13.
    Article 3 contains a revocation consequential upon the coming into operation of this order.

[1] 1975 c. 15; subsections (1B) and (1C) of section 64 were inserted by paragraph 3 of Schedule 3 to the Health and Social Security (Northern Ireland) Order 1984 (S.I. 1984/1158 (N.I. 8)) and section 64 (1B) was amended by Article 2 of the Social Security (Industrial Injuries) (Dependency) (Permitted Earnings Limits) (Northern Ireland) Order 1990 (S.R. 1990 No. 124). Section 64 ceased to have effect except for existing beneficiaries from 6th April 1987 by virtue of paragraph 4 of Schedule 3 to the Social Security (Northern Ireland) Order 1986 (S.I. 1986/1888 (N.I. 18)) back
