The Secretary of State is designated for the purposes of section 2(2) of the European Communities Act 1972(1) in relation to measures relating to the control of air pollution(2).
He makes these Regulations in exercise of the powers conferred by that section.
S.I. 1988/785. The power of the Secretary of State, as a Minister designated in relation to measures relating to the control of air pollution, to make regulations which extend to Scotland remains exercisable by virtue of section 57(1) of the Scotland Act 1998 (c. 46). Back [2]
