The Secretary of State for Children, Schools and Families makes the following Order in exercise of the powers conferred by sections 39(1)(a) and 44(1) of the Childcare Act 2006(1):

Citation and commencement

1.  This Order may be cited as the Early Years Foundation Stage (Learning and Development Requirements) (Amendment) Order 2008, and comes into force on 1st September 2008.

Amendment to the Early Years Foundation Stage (Learning and Development Requirements) Order 2007

2.  In Article 2 (interpretation) of the Early Years Foundation Stage (Learning and Development Requirements) Order 2007(2), for the definition of “the Document”, substitute—

“the Document” means the Document entitled “Statutory Framework for the Early Years Foundation Stage” published by the Secretary of State on 19th May 2008 with ISBN 978-1-84775-128-7..

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Early Years Foundation Stage (Learning and Development Requirements) Order 2007 (S.I. 2007/1772) (“the 2007 Order”), which specifies the learning and development requirements and gives legal effect to “the Document” entitled “Statutory Framework for the Early Years Foundation Stage”.

Early years providers must secure that their provision meets the learning and development requirements, which are contained in Section 2 of that document. The learning and development requirements, together with the welfare requirements, are specified under section 39 of the Childcare Act 2006 and make up the Early Years Foundation Stage.

Article 2 of this Order replaces the definition of “the Document” in the 2007 Order so that it refers to a new version of the document entitled “Statutory Framework for the Early Years Foundation Stage”, published by the Department for Children, Schools and Families on 19th May 2008 with ISBN 978-1-84775-128-7. No amendments have been made to the learning and development requirements in Section 2 of that document, and so no consultation has been conducted on this occasion.

No impact assessment has been prepared for this Order because no additional impact on business, charities, voluntary bodies or the public sector is foreseen. An impact assessment relating to the Early Years Foundation Stage was prepared, and subsequently updated for the Early Years Foundation Stage (Exemptions from Learning and Development Requirements) Regulations 2008 (S.I. 2008/1743), which is annexed to the Explanatory Memorandum which is available alongside that instrument on the OPSI website: http://www.opsi.gov.uk.
