These Regulations are made in exercise of the powers conferred by section 2(2) of the European Communities Act 1972(1) and section 56 of the Finance Act 1973(2).

The Secretary of State for Environment, Food and Rural Affairs has been designated for the purposes of section 2(2) of the European Communities Act 1972 in relation to measures relating to the requirement for an assessment of the impact on the environment of projects likely to have significant effects on the environment(3).

The Secretary of State for Environment, Food and Rural Affairs, with the consent of the Treasury, makes the following Regulations:

1972 c.68. The enabling powers conferred by section 2(2) were extended by virtue of the amendment of section 1(2) of the European Communities Act 1972 by section 1 of the European Economic Area Act 1993 (c. 51). As regards functions transferred to the Scottish Ministers by the Scotland Act 1998 (c.46), these Regulations extend to Scotland pursuant to section 57(1) of that Act. Back [1]
