The Lord Chancellor makes the following Rules in exercise of the powers conferred by paragraph 5 of Schedule 3 to the Terrorism Act 2000(1) and having had regard to the considerations specified in paragraph 5(2) of that Schedule.

In accordance with paragraph 5(5) of that Schedule, a draft of these Rules has been laid before Parliament and approved by a resolution of each House of Parliament.

2000 c.11. Paragraph 5 was amended by section 22(1) and (11) of the Terrorism Act 2006 (c.11). By virtue of section 9 of the 2000 Act, where rules within the meaning of section 7 of the Human Rights Act 1998 (c.42) provide for proceedings under section 7(1) of that Act to be brought before the Commission, the powers conferred by paragraph 5 of Schedule 3 to the 2000 Act apply to such proceedings. Section 9 was amended by sections 22(1) and (9) and 37(5) of, and Schedule 3 to, the Terrorism Act 2006 and by section 82(1) of, and paragraph 12(1) of Schedule 4 to, the Regulation of Investigatory Powers Act 2000 (c.23).
