The Secretary of State, in exercise of the powers conferred by section 2 of the Election Publications Act 2001,[1] makes the following order: 1. This Order may be cited as The Political Parties, Elections and Referendums Act 2000 (Commencement No. 3 and Transitional Provisions) Order 2006. 2. This Order does not extend to Northern Ireland. 3. Subject to article 5, the day appointed for the coming into force of the following provisions is 1st January 2007—
(b) paragraph 14 of Schedule 18 to that Act[3] (replacement of section 110 of the Representation of the People Act 1983).

Subject to article 5, section 1(1) and (2)(a) of the Election Publications Act 2001 shall cease to have effect on 1st January 2007. (This note is not part of the Order) This Order brings into force (in England and Wales and Scotland) section 143 of, and paragraph 14 of Schedule 18 to, the Political Parties, Elections and Referendums Act 2000 (c. 41) ("the 2000 Act"). These provisions were commenced on 16th February 2001 by the Political Parties, Elections and Referendums Act (Commencement No. 1 and Transitional Provisions) Order 2001 (S.I. 2001/222). However, this commencement was deemed not to have had effect by section 1 of the Election Publications Act 2001 (c. 5) ("the 2001 Act"). That Act provided for the provisions to be brought into force on a day appointed by the Secretary of State. That day is 1st January 2007, although transitional provision is made such that the provisions will not apply to irregular elections (such as by-elections) held in the period ending on 2nd May 2007. (This note is not part of the Order) The following provisions of the 2000 Act have been brought into force by commencement orders made before this Order. Amendments to the 2000 Act are not included in the sections or ranges of sections mentioned here.
