The Secretary of State is a Minister designated for the purposes of section 2(2) of the European Communities Act 1972[1] in relation to the recognition of higher education diplomas, formal qualifications, or experience in the occupation, required for the pursuit of professions or occupations[2].
Accordingly the Secretary of State, in exercise of the powers conferred upon him by section 2(2) of that Act, makes the following Regulations:
Citation and commencement
1. —(1) These Regulations may be cited as the European Communities (Recognition of Professional Qualifications) (Second General System) (Amendment) Regulations 2006.
(2) These Regulations come into force on 1st January 2007.
Amendment to the European Communities (Recognition of Professional Qualifications) (Second General System) Regulations 2002
2. The European Communities (Recognition of Professional Qualifications) (Second General System) Regulations 2002[3] are amended as set out in the Schedule.

In Schedule 6, Part 1, under heading "3. Seafaring sector, Training for the following: (a) Sea transport"—

(a) the following is inserted after the entry for the Netherlands, which ends with the words “VTS-official ("VTS-functionaris"),“—

for Maritime helmsman II/4 ST CW ("timonier maritim"), a person not less than 18 years of age who:
-
(i) holds an appropriate certificate of competence of seaman (secondary school maritime studies); has completed a period of seagoing service of 24 months as seaman on board seagoing ships, out of which at least 12 months have been performed within the last five year years; has attended an approved course for promotion to execution level (7 days); or
(ii) holds an appropriate certificate of competence of seaman (secondary school maritime studies) and holds a certificate of competence of radio operator, techno-operator in the maritime mobile service; has completed a period of seagoing service of 24 months as seaman and as radio operator, techno-operator in the maritime mobile service, or GMDSS-GOC operator; has attended an approved course for promotion to execution level (7 days),".

These Regulations amend the European Communities (Recognition of Professional Qualifications) (Second General System) Regulations 2002 ("the 2002 Regulations") (S.I. 2002/2934). The 2002 Regulations were amended by the European Communities (Recognition of Professional Qualifications (Second General System) (Amendment) Regulations 2005, S.I. 2005/882. The 2002 Regulations as amended give effect in the United Kingdom to Council Directive 92/51/EEC (OJ No. L209, 24.7.92, P.25) on the second general system for the recognition of professional education and training which supplements Council Directive 89/48/EEC on a general system for the recognition of higher education diplomas awarded on completion of professional education and training of at least three years' duration (OJ No. L19, 24.1.89, P16), as amended.
These Regulations give effect in the United Kingdom to Council Directive 2006/100/EC dated 20th November 2006 (OJ No. L…) adapting certain directives in the field of freedom of movement of persons, by reason of the accession of the Republics of Bulgaria and Romania, which amends Annex C to Council Directive 92/51/EEC. They do this by way of amending Schedule 6, Part 1 of the 2002 Regulations following the coming into force on 1st January 2007 of the Treaty of Accession of Bulgaria and Romania to the European Union signed at Luxembourg on 25th April 2005.
A full regulatory impact assessment has not been produced for this instrument as it has no impact on the burdens on the private or voluntary sectors.
