      IMMIGRATION

      The Nationality, Immigration and Asylum Act 2002 (Commencement No. 12) Order 2006

        Made 23rd November 2006 

      The Secretary of State, in exercise of the powers conferred by section 162(1) of the Nationality, Immigration and Asylum Act 2002[1], makes the following Order:

           1. This Order may be cited as the Nationality, Immigration and Asylum Act 2002 (Commencement No. 12) Order 2006.

          
      2. Section 10(5) of the Nationality, Immigration and Asylum Act 2002 except for paragraph (a) of that provision shall come into force on 21st December 2006.

      EXPLANATORY NOTE

      (This note is not part of the Order)


      This Order brings into force on 21st December 2006 section 10(5) of the Nationality, Immigration and Asylum Act 2002. Paragraph (a) of section 10(5) is excluded from the commencement of that provision. This is because it repeals part of a provision (section 3(9) of the Immigration Act 1971[
      2]) which is replaced in its entirety by an amendment made by section 30 of the Immigration, Asylum and Nationality Act 2006[3]. That section was brought into force by the Immigration, Asylum and Nationality Act 2006 (Commencement No. 1) Order 2006[4].
