The Secretary of State makes the following Order in exercise of the powers conferred by section 95 of the Local Government Act 2003[1]. Citation and commencement 1. This Order may be cited as the Local Government (Best Value Authorities) (Power to Trade) (Amendment) (England) Order 2006 and shall come into force on 15th December 2006. Amendment of the Local Government (Best Value Authorities) (Power to Trade) (England) Order 2004 2. —(1) The Local Government (Best Value Authorities) (Power to Trade) (England) Order 2004[2] is amended as follows. (2) For article 1(2)(b) substitute—
(ii) "good"; (iii) "fair"; (iv) "4 stars"; (v) "3 stars"; (vi) "2 stars"; or (vii) "1 star"."
(This note is not part of the Order) The Local Government (Best Value Authorities)(Power to Trade) (England) Order 2004 ("the principal Order") provides a power to trade to those local authorities whose performance has been categorised, by an order made under section 99(4) of the Local Government Act 2003, as excellent, good or fair. The power to trade is also subject to the conditions set out in article 2 of the principal Order. This amending Order extends the power to trade to those local authorities whose performance has been categorised by an order, made under section 99(4) of the Local Government Act 2003, as "4 stars" "3 stars" "2 stars" and "1 star".
