The Secretary of State makes the following Order in exercise of the powers conferred by section 3(3) of the Private Security Industry Act 2001[1]. In accordance with section 24(4)[2] of that Act he has consulted with the Security Industry Authority and the Scottish Ministers. Citation, commencement and extent 1. —(1) This Order may be cited as the Private Security Industry Act 2001 (Designated Activities) (Amendment No. 2) Order 2006 and shall come into force on 11th July 2006. (2) This Order extends to England and Wales. Amendment of the Private Security Industry Act 2001 (Designated Activities) Order 2006 2. —(1) Article 2 (designated activities) of the Private Security Industry Act 2001 (Designated Activities) Order 2006[3] is amended as follows. (2) In paragraph (2)(a) omit "except in the cases specified in paragraph (3)". (3) Paragraphs (3) and (4) are omitted. Revocation 3. The Private Security Industry Act 2001 (Designated Activities) (Amendment) Order 2006[4] is revoked. Vernon Coaker Parliamentary Under-Secretary of State Home Office 6th July 2006 (This note is not part of the Order) Article 2 of this Order amends the Private Security Industry Act 2001 (Designated Activities) Order 2006 ("the 2006 Order") to remove the amendments made to that Order by the Private Security Industry Act 2001 (Designated Activities) (Amendment) Order 2006 ("the amending Order"). Consequently, the 2006 Order will, inter alia, designate all manned guarding activities set out in paragraph 2 of Schedule 2 to the Private Security Industry Act 2001 ("the 2001 Act") for the purposes of section 3 of that Act (licensable conduct) without the exceptions which were previously made to that designation by the amending Order. Article 3 of this Order revokes the amending Order. Amendments made to Schedule 2 to the 2001 Act by the Private Security Industry Act (Amendments to Schedule 2) Order 2006[5], which will come into force on the same day as this Order does, will remove from the scope of the 2001 Act those same activities which were previously excepted from the designation by the amending Order.
