The Secretary of State makes the following Order in exercise of the powers conferred on him by section 61(4) of the Serious Organised Crime and Police Act 2005[1]. 1. —(1) This Order may be cited as the Serious Organised Crime and Police Act 2005 (Amendment of Section 61(1)) Order 2006 and shall come into force on the day after the day on which it is made. (2) This Order extends to England and Wales only. 2. At the end of section 61(1) of the Serious Organised Crime and Police Act 2005 (offences to which Chapter 1 of Part 2 of that Act applies) there is added—
(ii) any offence under section 1 of the Public Bodies Corrupt Practices Act 1889 (c.69) (corruption in office); (iii) the first two offences under section 1 of the Prevention of Corruption Act 1906 (c.34) (bribes obtained by or given to agents)."
(This note is not part of the Order) Section 61(1) of the Serious Organised Crime and Police Act 2005 lists the offences to which Chapter 1 of Part 2 of that Act applies. That Chapter confers powers on the Director of Public Prosecutions, the Director of Revenue and Customs Prosecutions and the Lord Advocate in relation to the giving of disclosure notices in connection with the investigation of offences to which that Chapter applies (see section 60(1) of that Act).
