The Secretary of State, in exercise of the powers conferred by sections section 78 of the Trade Marks Act 1994[1] and section 36 of the Registered Designs Act 1949[2], makes the following Rules: Citation and commencement 1. These Rules may be cited as the Trade Marks and Designs (Address For Service) (Amendment) Rules 2006 and shall come into force immediately after the Patents, Trade Marks and Designs (Address For Service and Time Limits, etc) Rules 2006[3] on 6th April 2006. 2. In rule 8(5) of the Registered Designs Rules 1995[4], for "comptroller" substitute "registrar". 3. In rule 10(5) of the Trade Marks Rules 2000[5], for "comptroller" substitute "registrar". Gerry Sutcliffe Parliamentary Under Secretary of State for Employment Relations and Consumer Affairs Department of Trade and Industry 3rd April 2006 (This note is not part of the Rules) These Rules correct rule 8(5) of the Registered Design Rules (SI 1995/2912) and rule 10(5) of the Trade Mark Rules 2000 (SI 2000/136). Both of these provisions were amended incorrectly by the Patents, Trade Marks and Designs (Address For Service and Time Limits, etc) Rules 2006 (SI 2006/760). These Rules substitute the word "registrar" for the word "comptroller" in both rule 8(5) of the Registered Design Rules 1995 and rule 10(5) of the Trade Mark Rules 2000. Notes: [1] 1994 c.26.back [2] 1949 c. 88; section 36(1A) was inserted by section 272 of, and paragraph 26(1) of Schedule 3 to, the Copyright, Designs and Patents Act 1988 (c. 48), there are other amendments but none is relevant.back [4] SI 1995/2912; rule 8 was substituted by SI 2006/760, to which there are other amendments not relevant to these Rules.back [5] SI 2000/136; rule 10 was substituted by SI 2006/760, to which there are other amendments not relevant to these Rulesback
