The Secretary of State for Health makes the following Order in exercise of the powers conferred by sections 64(6) and 70 of the Health and Social Care Act 2001[1].[a]
Citation, interpretation and application
1. —(1) This Order may be cited as the Health and Social Care Act 2001 (Commencement No. 14) (England) Order 2006.
(2) In this Order, "the Act" means the Health and Social Care Act 2001.
(3) This Order applies in relation to England only.
Appointed day in respect of provision for local pharmaceutical services schemes
2. —(1) 28th February 2006 is the appointed day for the coming into force of—
-
(a) section 40 of the Act (provision for LPS services); and
(b) Schedule 3 to the Act,
for the purpose of making regulations.
(2) 1st April 2006 is the appointed day for the coming into force of—
-
(a) section 40 of the Act in so far as not already in force;
(b) Schedule 3 to the Act in so far as not already in force; and
(c) Paragraphs 5(12)(a) and 11(4) of Schedule 5 to the Act (minor and consequential amendments) and, in so far as it relates to those paragraphs, section 67(1) of the Act.
Appointed day in respect of pharmaceutical services

1st April 2006 is the appointed day for the coming into force of Part 2 of Schedule 6 and, in so far as it relates to that Part, section 67(2) to the Act (repeals).

This Order is the fourteenth Commencement Order made under the Health and Social Care Act 2001 ("the Act") relating to England. It applies in relation to England only.
Article 2(1) brings into force on 28th February 2006 section 40 of the Act for the purposes of making regulations (which relate to the local pharmaceutical services schemes).
Article 2(2) brings into force on the 1st April 2006 section 40 of the Act for all purposes and paragraphs 5(12)(a) and 11(4) of Schedule 5 to the Act (which makes consequential amendments to the provisions of the National Health Service Act 1977).
Article 3 brings into force on the 1st April 2006 Part 2 of Schedule 6 which makes repeals relating to section 41 of the National Health Service Act 1977 and section 67(2) in so far as it relates to that Part.

The provisions of the Health and Social Care Act 2001 listed in the table below have been brought into force in England by Commencement Orders made before the date of this Order. Certain provisions of Commencement Orders S.I. 2001/3752 and 2002/1095, 1170 and 1312 have effect in Northern Ireland, Scotland and Wales. The following Commencement Orders have been made in relation to Wales only: S.I.2001/3087, 2002/1475 and 1919, 2003/ 713 and 939 and 2004/103 and 1754.
