Her Majesty deems it expedient to amend the Naval, Military and Air Forces Etc. (Disablement and Death) Service Pensions Order 1983[1] by Order in Council in pursuance of section 12(1) of the Social Security (Miscellaneous Provisions) Act 1977[2]. ACCORDINGLY, Her Majesty, in exercise of the powers conferred by section 3 of the Naval and Marine Pay and Pensions Act 1865[3], section 2(1) of the Pensions and Yeomanry Pay Act 1884[4], section 2(1) of the Air Force (Constitution) Act 1917[5] and section 12(1) and 24(3) of the said Act of 1977, and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:- Citation, commencement and interpretation 1. —(1) This Order may be cited as the Naval, Military and Air Forces Etc. (Disablement and Death) Service Pensions (Amendment) Order 2006. (2) In this Order, "the Service Pensions Order" means the Naval, Military and Air Forces Etc. (Disablement and Death) Service Pensions Order 1983. (3) This Order shall come into force on 13th March 2006. Amendment to the Service Pensions Order 2. —(1) The Service Pensions Order shall be amended in accordance with the following provisions. (2) In the Table at Part IV of Schedule 1 to the Service Pensions Order, in row number 12, relating to "part-time treatment allowance under article 25", under the column headed "Groups 1-9", for the figure "£59.00" there shall be substituted the figure "£60.20" (3) In the Table at Part IV of Schedule 1 to the Service Pensions Order, in row number 12, relating to "part-time treatment allowance under article 25", under the column headed "Groups 10-15", for the figure "£59.00" there shall be substituted the figure "£60.20" (4) These amendments shall have effect as if they had come into force on 11th April 2005. (Disablement and Death) Service Pensions Order 1983 ("the Service Pensions Order") in the manner described below. The Service Pensions Order sets out the rates of retired pay, pensions, gratuities and allowances in respect of disablement or death due to service in the armed forces. The Table at Part IV of Schedule 1 to that Order details rates of allowance payable in respect of disablement and earnings or income thresholds. The amounts set out in the Service Pensions Order are subject to annual revision. The Naval, Military and Air Forces Etc. (Disablement and Death) Service Pensions (Amendment) Order 2005 (SI 2005/851) amended the Service Pensions Order, amongst other things, by inserting a revised version of the Table at Part IV of Schedule 1 to that Order. The revised Table contained an error in relation to the figure specified for part time treatment allowances. This Order amends the Service Pensions Order by substituting the correct figure with effect from the date of the earlier revision. A regulatory impact assessment has not been produced for this instrument as it has no significant impact on the costs of business, charities or voluntary bodies.
