The Secretary of State certified for the purposes of section 35 of the Copyright, Designs and Patents Act 1988[1](the Act) a licensing scheme set out in the Copyright (Certification of Licensing Scheme for Educational Recording of Broadcasts and Cable Programmes) (Educational Recording Agency Limited) Order 1990[2] (the 1990 Order). The licensing scheme was subsequently varied on a number of occasions and amendments were made to the 1990 Order. The Secretary of State has been informed by the Educational Recording Agency Limited that the scheme certified in the 1990 Order (as varied) has now ceased to be operated. Accordingly, the Secretary of State, in exercise of the powers conferred upon him by section 143 of the Act, makes the following Order: 1. This Order may be cited as the Copyright (Certification of Licensing Scheme for Educational Recording of Broadcasts and Cable Programmes) (Educational Recording Agency Limited) (Revocation) Order 2006. 2. The following Orders are revoked—
(b) the Copyright (Certification of Licensing Scheme for Educational Recording of Broadcasts and Cable Programmes) (Educational Recording Agency Limited) (Amendment) Order 1992[3]; (c) the Copyright (Certification of Licensing Scheme for Educational Recording of Broadcasts and Cable Programmes) (Educational Recording Agency Limited) (Amendment) Order 1993[4]; (d) the Copyright (Certification of Licensing Scheme for Educational Recording of Broadcasts and Cable Programmes) (Educational Recording Agency Limited) (Amendment) Order 1994[5]; (e) the Copyright (Certification of Licensing Scheme for Educational Recording of Broadcasts and Cable Programmes) (Educational Recording Agency Limited) (Amendment) Order 1996[6]; (f) the Copyright (Certification of Licensing Scheme for Educational Recording of Broadcasts and Cable Programmes) (Educational Recording Agency Limited) (Amendment) Order 1998[7]; (g) the Copyright (Certification of Licensing Scheme for Educational Recording of Broadcasts and Cable Programmes) (Educational Recording Agency Limited) (Amendment) Order 1999[8]; (h) the Copyright (Certification of Licensing Scheme for Educational Recording of Broadcasts and Cable Programmes) (Educational Recording Agency Limited) (Amendment) Order 2003[9].
(This note is not part of the Order) The licensing scheme certified by the Secretary of State, which was operated by the Educational Recording Agency Limited, and was set out in the Copyright (Certification of Licensing Scheme for Educational Recording of Broadcasts and Cable Programmes) (Educational Recording Agency Limited) Order 1990 (SI 1990/879) (the 1990 Order) has ceased to operate. This Order revokes the 1990 Order and a number of other Orders which amended the 1990 Order following variations in the licensing scheme. The scheme certified in the 1990 Order has been superseded by a scheme certified and set out in the Copyright (Certification of Licensing Scheme for Educational Recording of Broadcasts) (Educational Recording Agency Limited) Order 2005 (SI 2005/222).
