The Secretary of State for Education and Skills makes the following Regulations, in exercise of the powers conferred upon her by sections 186 and 210 of the Education Act 2002[1]: 1. These Regulations may be cited as the Education (Teacher Student Loans) (Repayment etc.) (Amendment) Regulations 2005 and shall come into force on 30th December 2005. 2. The Education (Teacher Student Loans) (Repayment etc.) Regulations 2003[2] are amended as follows. 3. After paragraph (1) of regulation 4 insert the following—
(This note is not part of the Regulations) The Education (Teacher Student Loans) (Repayment etc.) Regulations 2003 ("the 2003 Regulations") provide for the reduction and repayment of student loans owed by newly qualified teachers employed in those subjects where there is a shortage of teachers. In order to be eligible for the loan repayment scheme, a teacher has to be employed under a contract of employment which commenced on or after 1st July 2002 and before 1st July 2005 (regulation 4(1)(c) of the 2003 Regulations). These Regulations amend the 2003 Regulations. The amendment provides that in the case of women who could not enter into a contract of employment by 30th June 2005 due to pregnancy or childbirth, the period for entering into a contract for eligible employment is extended by one year (regulation 3).
