      CHARITIES

      The Royal Patriotic Fund Corporation (Transfer of Property, Rights and Liabilities) Order 2005

        Made 1st December 2005 
        Laid before Parliament 7th December 2005 
        Coming into force 1st January 2006 

      The Secretary of State, in exercise of the powers conferred upon him by section 6 of the Armed Forces (Pensions and Compensation) Act 2004[1] makes the following Order:

      Citation and commencement
           1. This Order may be cited as the Royal Patriotic Fund Corporation (Transfer of Property, Rights and Liabilities) Order 2005, and shall come into force on 1st January 2006.

      Transfer
          
      2. —(1) On 1st January 2006, the property, rights and liabilities (including rights and liabilities under a contract of employment) of the Royal Patriotic Fund Corporation shall be transferred to the RPFC, which is a charity [2] registered under the Charities Act 1993[3] and established for the benefit of the persons falling within section 6(1)(a) and (b) of the Armed Forces (Pensions and Compensation) Act 2004.

          (2) Immediately after the transfer referred to above, the Royal Patriotic Fund Corporation shall be dissolved.

      EXPLANATORY NOTE

      (This note is not part of the Order)


      This Order provides for the transfer of the property, rights and liabilities of the Royal Patriotic Fund Corporation (a body corporate established under the Patriotic Fund Reorganisation Act 1903[
      4]) to the RPFC, a company registered under the Charities Act 1993, and for the dissolution of the Royal Patriotic Fund Corporation. The RPFC has been established for the benefit of the persons specified in section 6 of the Armed Forces (Pensions and Compensation) Act 2004. Schedule 2 to that Act makes further provision in relation to the transfer of employees to the RPFC.
