The Secretary of State makes the following Order in exercise of the powers conferred by sections 43B(1), 43C(3) and 60(5) of the National Lottery etc. Act 1993[1]. In accordance with section 43C(4) of that Act she has consulted such persons as appear to her to be appropriate. In accordance with section 60(2)[2] of that Act, a draft of this instrument was laid before Parliament and approved by a resolution of each House of Parliament. Citation and commencement 1. This Order may be cited as the New Opportunities Fund (Specification of Initiatives) (No.2) Order 2005 and shall come into force on the day after the day on which it is made. Specification of initiatives 2. —(1) For the purposes of section 43B(1) of the National Lottery etc. Act 1993 the following initiatives are specified—
(b) an initiative to promote community safety and cohesion; (c) an initiative to promote physical and mental well being; (d) an initiative to involve local people in small-scale projects in their communities that are concerned or connected with health, education or the environment.
(2) The reference in this Order to promoting community safety is to making communities places in which it is, or is perceived to be, safer to live and work, in particular by the reduction of actual or perceived levels of crime and other anti-social behaviour. 1. The New Opportunities Fund (Specification of Initiatives) Order 1998 (S.I. 1998/1598). 2. The New Opportunities Fund (Specification of Initiatives) Order 1999 (S.I. 1999/966). 3. The New Opportunities Fund (Specification of Initiatives) Order 2001 (S.I. 2001/1404). 4. The New Opportunities Fund (Specification of Initiative) Order 2004 (S.I. 2004/143). (This note is not part of the Order) This Order specifies initiatives concerned or connected with health, education or the environment and accordingly allows the New Opportunities Fund to make grants, or make or enter into arrangements, under section 43B of the National Lottery etc. Act 1993 which are designed to give effect to those initiatives. Notes: [1] 1993 c.39; sections 43B and 43C were inserted by section 7(2) of the National Lottery Act 1998 (c.22).back [2] Section 60(2) of the National Lottery etc. Act 1993 was amended, so as to include a reference to orders under section 43B of that Act, by section 15(2) of the National Lottery Act 1998. In section 60 of the 1993 Act, a reference to an order is a reference to an order of the Secretary of State: see section 60(6) which was inserted by section 15(6) of the 1998 Act.back
