In exercise of the powers conferred upon the Secretary of State by sections 408, 537A(1) and (2) and 569(4) of the Education Act 1996[1] and after consulting with those persons with whom consultation appeared to the Secretary of State to be desirable, the Secretary of State for Education and Skills hereby makes the following Regulations: Citation, commencement and application 1. —(1) These Regulations may be cited as the Education (School Performance Information) (England) (Amendment) (No. 2) Regulations 2005 and shall come into force on 16th September 2005. (2) These Regulations shall apply only in relation to England. Interpretation 2. In these Regulations any reference to the "Principal Regulations" is a reference to the Education (School Performance Information) (England) Regulations 2001[2]. Amendments to the Principal Regulations 3. The Principal Regulations shall be amended in accordance with regulations 4 to 11. 4. In regulation 7, insert the words "and the proprietor of every Academy" after the words "secondary school". 5. For regulation 8 substitute the following regulation—
8. The governing body of every maintained school and the proprietor of every non-maintained special school or independent school which has registered pupils who are at or near the end of the final year of the fourth key stage or who are aged 15 but are not at or near the end of the final year of the fourth key stage shall, within two weeks of receiving a written request from the Secretary of State, provide him with the information specified in Part 1 of Schedule 3."

After regulation 8, insert the following regulation—
8A. The governing body of every maintained school and the proprietor of every non-maintained special school or independent school which has registered pupils who are aged 16, 17 or 18 shall, within two weeks of receiving a written request from the Secretary of State, provide him with the information specified in Part 2 of Schedule 3."

In regulation 13—
(b) in paragraph (1), for the word "authority" substitute the words "Secretary of State"; and (c) in paragraphs (1) and (4), for the words "the third Thursday in January in each reporting school year" substitute the words "receiving a written request from the Secretary of State".

In Schedule 2—
(b) in paragraph 2(2)(iA), for the word "of" (where it first occurs) substitute the word "on"; (c) omit "or" at the end of paragraph 2 (2) (iv); (d) for the full stop at the end of paragraph 2 (2) (v) substitute a semi-colon and insert "or"; (e) after paragraph 2(2)(v), insert the following—
(f) after paragraph 2, insert the following paragraph—
(2) In respect of each such pupil, the level on the National Curriculum level scale achieved by the pupil as determined by the results of the NC tests taken early."

In Schedule 2A—
(b) in paragraph 2(2)(ii), for the word "of" (where it first occurs) substitute the word "on"; (c) omit "or" at the end of paragraph 2 (2) (v); (d) for the full-stop at the end of paragraph 2 (2) (vi) substitute a semi-colon and insert "or"; (e) after paragraph 2(2)(vi), insert the following—
(f) after paragraph 2, insert the following paragraph—
(2) In respect of each such pupil, the level on the National Curriculum level scale achieved by the pupil as determined by the results of the NC tests taken early."

In Schedule 3—
(b) for the heading to Part 1 of the Schedule, substitute the following heading—
(c) for paragraph 1 substitute the following paragraph—
(2) The number of registered pupils aged 15 who are not at or near the end of the final year of the fourth key stage.";
(e) omit "and" at the end of paragraph 3 (2)(a); (f) in paragraph 3(2), for paragraph (b) substitute the following paragraph—
(g) at the end of paragraph 3(2)(b), for the full-stop substitute a semi-colon and insert the following paragraphs—
(d) except where the pupil is registered at an independent school other than an Academy or CTC, the level on the National Curriculum level scale achieved by the pupil in the third key stage as determined by the results of NC tests in any of the school years preceding the reporting school year; and (e) except where the pupil is registered at an independent school other than an Academy or CTC, the level on the National Curriculum level scale achieved by the pupil in the second key stage as determined by the results of NC tests in any of the school years preceding the reporting school year.";
(h) omit paragraphs 4 and 5;
(2) In the case of each such pupil referred to in sub-paragraph (1), the following information—
(b) the external qualification taken and the grade or, where applicable, the level achieved; (c) the school year in which he was entered for the external qualification and the awarding body for that qualification."; and
(j) omit paragraphs 9 and 10.

In the heading to Schedule 10, for the words "Local Education Authorities" substitute the words "the Secretary of State". (This note is not part of the Regulations) These Regulations amend the Education (School Performance Information) (England) Regulations 2001. The principal amendments will—
(b) require maintained schools, non-maintained special schools and independent schools to provide the Secretary of State with information about the results of pupils at or near the end of the fourth key stage and of pupils aged 15 but not at or near the end of the fourth key stage (regulation 5); (c) require maintained schools to provide information about permanently excluded pupils to the Secretary of State instead of to their local education authorities (regulation 7); (d) require maintained primary and middle deemed secondary schools and Academies to provide the Secretary of State with information about the results of pupils in the second key stages who have taken one or two NC tests early (regulation 8); (e) require maintained secondary schools, Academies and CTCs to provide the Secretary of State with information about the results of pupils in the third key stage who have taken one or two NC tests early (regulation 9); and (f) require maintained schools, non-maintained special schools and independent schools to provide the Secretary of State with information about the results of pupils aged 16, 17 and 18 in external qualifications approved under section 98 of the Learning and Skills Act 2000 for use by those over compulsory schools age but have not attained the age of 19 (regulation 10 ).
