The Secretary of State, in exercise of the powers conferred upon her by section 153(4) of the Environmental Protection Act 1990[1], hereby makes the following Order: Citation, extent and commencement 1. This Order—
(b) extends to England and Wales and Northern Ireland only; and (c) shall come into force on 29th July 2005.
Variation of section 153(1) of the Environmental Protection Act 1990
(This note is not part of the Order) This Order varies section 153(1) of the Environmental Protection Act 1990. It enables the Secretary of State, with the consent of the Treasury, to give financial assistance to, or for the purposes of, the Bio-energy Infrastructure Scheme. It extends to England, Wales and Northern Ireland only. The purpose of the Scheme is to provide grant aid to farmers, foresters and businesses to help the development of the supply chain required to harvest, store, process and supply biomass to energy end-users. Details of the Scheme are available on the Department for Environment, Food and Rural Affairs' website at http://www.defra.gov.uk. Notes: [1] 1990 c.43; the relevant functions of the Secretary of State insofar as they relate to Scotland were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46).
