The Secretary of State for Health in exercise of the powers conferred upon him by section 200(1) and 201(1) of the Health and Social Care (Community Health and Standards) Act 2003[1] and of all other powers enabling him in that behalf, after consulting the National Assembly for Wales in accordance with section 199(2)(b)(iv) of that Act, hereby makes the following Order: - Citation, commencement and interpretation 1. - (1) This Order may be cited as the Health and Social Care (Community Health and Standards) Act 2003 (Commission for Healthcare Audit and Inspection) (Transitional Provisions) Order 2005 and shall come into force on 31st March 2005. (2) In this Order -
CHI - Accounts (This note is not part of the Order) This Order makes transitional provision in connection with the coming into force of Part 2 of the Health and Social Care (Community Health and Standards) Act 2003 ("the Act"). Part 2 of the Act is concerned with the establishment and functions of the Commission for Healthcare Audit and Inspection ("the CHAI"), also known as the "Healthcare Commission", and the Commission for Social Care Inspection ("the CSCI"). The CHAI will now carry out functions formerly carried out by the Commission for Health Improvement ("CHI") which was established under the Health Act 1999 and which is abolished under the Act. Article 2 makes transitional provision for CHAI to prepare the annual accounts of CHI for the financial year 2003 - 2004, and for the Comptroller and Auditor General to examine, certify and report on those accounts, and to lay copies of those accounts and his report before Parliament.
