The Electoral Commission[1], in exercise of the powers conferred upon them by sections 17[2] and 26[3] of the Local Government Act 1992, hereby make the following Order: Citation and commencement 1. - (1) This Order may be cited as the Borough of Stockton-on-Tees (Electoral Changes) (Amendment) Order 2005. (2) This Order shall come into force on the day after that on which it is made. Amendment to the 2003 Order 2. - (1) The Borough of Stockton-on-Tees (Electoral Changes) Order 2003[4] shall be amended as follows: (2) In article 1(3)(a), "15th October 2006" shall be substituted for "15th October 2007". (3) After article 3 shall be inserted -
3A. - (1) Elections of all councillors for all wards of the borough shall be held simultaneously on the ordinary day of election of councillors in 2005[5]. (2) The councillors holding office for any ward of the borough immediately before 9th May 2005 shall retire on that date and the newly elected councillors shall come into office on that date. (3) The term of office of every councillor elected on the ordinary day of election of councillors in 2005 shall be two years; and each such councillor shall, unless he resigns his office or it otherwise becomes vacant, continue to hold office until the fourth day after the ordinary day of election of councillors in 2007.".
(This note is not part of the Order) This Order amends the Borough of Stockton-on-Tees (Electoral Changes) Order 2003 to make provision for a whole council election in 2005 and a return to the council's normal cycle of elections in 2007. It also amends the commencement date of articles 4, 5, 6, 7 and 8 of the 2003 Order. Notes: [1] The Electoral Commission was established by the Political Parties, Elections and Referendums Act 2000 (c.41). The functions of the Secretary of State, under sections 13 to 15 and 17 of the Local Government Act 1992 (c.19), so far as they relate to electoral changes within the meaning of that Act, were transferred with modifications to the Electoral Commission by the Local Government Commission for England (Transfer of Functions) Order 2001 (S.I. 2001/3962).back [2] 1992 c.19.
