The Secretary of State, in exercise of the powers conferred upon him by sections 113(1)(b), 114(1)(b), 115(1)(b), 116(1)(b) and 125(1) and (5) of the Police Act 1997[1],and having regard to the meaning of "prescribed" hereby makes the following Regulations: Citation, commencement, interpretation and extent 1. - (1) These Regulations may be cited as the Police Act 1997 (Criminal Records) (Amendment) Regulations 2005. (2) This regulation and regulation 2 shall come into force on 25th March 2005 and regulation 3 shall come into force on 1st April 2005. (3) In these Regulations "the 2002 Regulations"[2] means the Police Act 1997 (Criminal Records) Regulations 2002. (4) These Regulations extend to England and Wales. Fees payable to police authorities for information provided to the Secretary of State 2. For Schedule 3 to the 2002 Regulations there shall be substituted the Schedule set out in the Schedule to these Regulations. Fees for criminal record certificates and enhanced criminal record certificates 3. - (1) In regulation 4 of the 2002 Regulations for "£28" there shall be substituted "£29". (This note is not part of the Regulations) These Regulations amend the Police Act 1997 (Criminal Records) Regulations 2002. Regulation 2 inserts a new Schedule 3 setting out revised fees payable to the police for each request for information under sections 115, 116 or 120A(4) (inserted by section 134(1) of the Criminal Justice and Police Act 2001 (c.16)) of the Police Act 1997. The amendments to the fees payable have effect from 25th March 2005. Regulation 3 substitutes new fees for applications for criminal record certificates and enhanced criminal record certificates. The cost of a criminal record certificate rises from £28 to £29. The cost of an enhanced criminal record certificate rises from £33 to £34. The rises have effect from 1st April 2005.
