      HIGHWAYS, ENGLAND

      The North of Worsley - West of Moss Moor Motorway Connecting Roads (No. 3) Special Roads Scheme 1966 (Variation) Scheme 2004

        Made 30th December 2004 
        Coming into force 31st December 2004 

      The Secretary of State for Transport makes this Scheme in exercise of powers conferred by sections 16 and 17 and 19 of the Highways Act 1980[1], and now vested in him[2], and of all other powers enabling him in that behalf: - 

           1.  - (1) The North of Worsley - West of Moss Moor Motorway Connecting Roads (No. 3) Special Roads Scheme 1966[3] (hereinafter referred to as "the Principal Scheme") is hereby varied as follows:

        (a) in article 2 of the Principal Scheme, for the words "the deposited plan" substitute the words "the further plan";

        (b) after the first sub-paragraph of article 4 of the Principal Scheme insert the following sub-paragraph - 

        "the further plan" means the plan numbered HA/18/OD/22 and marked "the North of Worsley - West of Moss Moor Motorway Connecting Roads (No. 3) Special Roads Scheme 1966 (Variation) Scheme 2004" signed by authority of the Secretary of State for Transport and deposited at the DTLR, Records Management Branch, Ashdown House, Sedlescombe Rd North, St Leonards-on-Sea, East Sussex TN37 7GA;

        (c) for paragraph 1 of the Schedule to the Principal Scheme substitute - 

      In the following paragraph: - 

        "the reference point" means in sub-paragraph (a) the point of intersection of the centre line of the M62 Motorway and the centre line of Dig Gate Lane, and in sub-paragraph (b) and (c) means the point of intersection of the centre line of the M62 Motorway and the centre line of the A640 Elizabethan Way;

        "the roundabout" means the A640 Elizabethan Way Roundabout shown on the further plan;

        "the new local authority road" means the road which the Secretary of State proposes to construct and referred to in articles 1(1)(a) and (c) of the M62 Motorway (Junction 21 Improvements) (Side Roads) Order 2004;

        "the new local authority roundabout" means the roundabout which the Secretary of State proposes to construct and referred to in article 1(1)(c) of the M62 Motorway (Junction 21 Improvements) (Side Roads) Order 2004;

        (d) for paragraph 2 of the Schedule to the Principal Scheme substitute - 

             " 2. The routes described in this paragraph are shown on the further plan and are routes:

          (a) starting at a point adjoining the westbound carriageway of the M62 Motorway about 620 metres south west of the reference point and proceeding in an easterly, thence southerly, thence westerly, thence north-westerly direction to join the new local authority roundabout at a point just beyond the eastbound carriageway of the M62 Motorway.

          (b) starting at a point adjoining the eastbound carriageway of the M62 Motorway about 160 metres north east of the reference point and proceeding in a south-westerly, thence westerly, thence northerly direction to join the new local authority road to the south west of the roundabout.

          (c) starting at a point adjoining the westbound carriageway of the M62 Motorway about 450 metres north east of the reference point and proceeding in a south-westerly, thence westerly, thence north-westerly direction to join the new local authority roundabout at a point just beyond the eastbound carriageway of the M62 Motorway."

          (2) The heavy black lines on the deposited plan referred to in the North of Worsley - West of Moss Moor Connecting Roads (No. 3) Special Roads Scheme 1966 shall be disregarded. The heavy black lines on the further plan shall indicate the centre lines of the special roads.

           2. This Scheme may be cited as the North of Worsley - West of Moss Moor Motorway Connecting Roads (No. 3) Special Roads Scheme 1966 (Variation) Scheme 2004 and shall come into operation on 31st December 2004.
