Whereas a draft of this Order in Council has been approved by resolution of each House of Parliament: Now, therefore, Her Majesty, in exercise of the powers conferred by paragraph 1(1) of the Schedule to the Northern Ireland Act 2000 (c.1) and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows: - Title and commencement 1. - (1) This Order may be cited as the Roads (Amendment) (Northern Ireland) Order 2004. (2) This Order comes into operation on the expiration of two months from the day on which it is made. Interpretation 2. The Interpretation Act (Northern Ireland) 1954 (c.33) applies to this Order as it applies to an Act of the Assembly. Concurrent procedures under the Roads Order 3. - (1) The Roads (Northern Ireland) Order 1993 (NI 15) is amended as follows. (2) In Article 133 omit paragraphs (2) and (3) (proceedings which may be taken concurrently with proceedings under Schedule 8). (3) After that Article insert -
133A. All or any of the following proceedings required to be taken by this Order for the purposes of, or in connection with, a road or proposed road may (so far as practicable) be taken concurrently -
(b) proceedings required to be taken under Articles 67 to 67B (procedure for environmental impact assessment); (c) proceedings required to be taken under Article 113 and Schedule 7 (procedure for making vesting orders).".
(This note is not part of the Order) This Order amends the Roads (Northern Ireland) Order 1993 to enable proceedings required by Articles 67 to 67B (environmental assessment), Schedule 7 (vesting orders) and Schedule 8 (orders in connection with roads) to be taken concurrently.
